Welcome to MyAfriStyle! These Terms of Service ("Terms") govern your use of our website, applications, and services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms and our Privacy Policy.

1. Our Platform

MyAfriStyle is a platform that connects users seeking unique African fabrics and fashion design services ("Customers") with talented fashion designers ("Designers"). Our services include showcasing fabrics, designer portfolios, facilitating bookings, and allowing user reviews. We are a marketplace and do not act as an agent for either party.

2. User Accounts & Roles

To access most features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

• Customers: Users who browse the platform, book consultations, and review fabrics or designers.
• Designers: Users who have been approved by MyAfriStyle to create a professional profile, showcase their portfolio, and submit fabrics to the platform.
• Administrators: Employees or agents of MyAfriStyle responsible for managing the platform.

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Designer and Fabric Submissions

Designers may submit fabrics and portfolio items to be displayed on the Platform. By submitting content, you represent and warrant that:

• You own the content or have the necessary rights and permissions to submit it.
• The content is accurate, not confidential, and not in violation of any contractual restrictions or other third-party rights.
• You grant MyAfriStyle a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, display, reproduce, and distribute your submitted content in connection with the Platform.

MyAfriStyle reserves the right to approve, reject, or remove any submitted content at its sole discretion.

4. Bookings and Transactions

The Platform facilitates bookings between Customers and Designers. When a booking is made, a direct contract is formed between the Customer and the Designer. MyAfriStyle is not a party to this contract.

• Designers are responsible for setting their own prices, managing their availability, and fulfilling the services as described in their profile.
• Customers are responsible for making timely payments and providing accurate information for bookings.

5. User Conduct and Content

You are solely responsible for your conduct and any data, text, information, usernames, graphics, images, photos, profiles, audio and video clips, links, comments, and reviews ("User Content") that you submit, post, and display on the MyAfriStyle platform. You agree not to:

• Post any content that is illegal, fraudulent, defamatory, obscene, or infringing on intellectual property rights.
• Harass, threaten, or intimidate other users.
• Use the Platform for any illegal or unauthorized purpose.
• Attempt to circumvent any security features of the Platform.

6. Intellectual Property

All content on the Platform, excluding User Content, including text, graphics, logos, images, and software ("Platform Content"), is the property of MyAfriStyle or its licensors and is protected by Canadian and international copyright, trademark, and other laws.

7. Disclaimers and Limitation of Liability

The platform is provided on an "as is" and "as available" basis. MyAfriStyle makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. We do not warrant that the service will be uninterrupted, timely, secure, or error-free.

In no event shall MyAfriStyle, its directors, employees, or agents be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

8. Indemnification

You agree to defend, indemnify, and hold harmless MyAfriStyle and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (a) your use and access of the Service, by you or any person using your account and password; (b) a breach of these Terms, or (c) Content posted on the Service.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be resolved through binding arbitration in Winnipeg, Manitoba, except that you may assert claims in small claims court if your claims qualify.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
